EXPLANATION OF THE REASONS
A healthy familiar co-existence with the peacefulness of having a veranda to the lake, to have the privilege of water and achieve an authentic harmony of man to man and the nature that surrounds them. Preserving our beautiful environment for future generations, we are obligated to respect the following regulations which have been designed for the benefit of all.
The J. of M.M. C. y M. of the Fraccionamiento San Juan Cósala Raquet Club A.C. was conceived and designed to be a residential zone of excellence, which would have the following characteristics:
PRECEDENT
- Areas with abundant landscaping and trees to achieve a nice image and pleasant stay, a healthy environment and coexisting for all its inhabitants and for all those who visit and transit the fraccionamiento (tourist, family members, friends etc.)
Since the time the fraccionamiento has been, we have sought to reaffirm this original vocation, to improve its image and enabling for all as much as possible.
OBJECTIVES
1.- Reaffirm the benefit of all the residents of Fraccionamiento San Juan Cosala Racquet Club, the original vocation of maintaining an adequate visual image and the ecological, sanitary and social balance.
2.- Maintain the development of the community within the legal guidelines stipulated in the Law of Fraccionamientos Urbanos de Estado de Jalisco and other correlatives.
3.- Achieve a healthy co-existence, security and respect for the rights among the diverse elements which inhabit or transit the fraccionamiento.
4.- Facilitate the healthy collaboration between the residents of the J. of M.M.C. and M. of the Fraccionamiento San Juan Cosala Raquet Club represented by its Board of Directors before any Federal, State or Municipal authorities, solving any circumstance or action which could hinder this necessary and healthy collaboration.
5.- The constructions and renovations will be presented to the association to obtain a written approval and then be followed by prior requirements of the Departments of Public Works and other governmental entities, to grant the corresponding licenses and permits with the objective of conserving and caring of harmony and aesthetics of the colony. As well as paying the corresponding quotas.
For an adequate protection of the appearance and the achievement of ambiance in the entire colony, central medians, wooded areas and public or private green areas, it must be watched by the Administration of the Fraccionameinto and property owners to a maximum.
Public and private easements destined for green areas shall be under the good care of the property owner, public easements such as central median shall be destined invariably for green and wooded areas, the Home Owner Association of Fraccionamiento San Juan Cosala Raquet Club, A.C. in agreement with private individuals will collaborate in the replacement of tress in deforested areas ensuring special and adequate plants for each area.
Any type of sign in public areas of the Fraccionamiento is prohibited. Any sign installed on private property must have a municipal license and previous written approval from the association, which will take into account the type of sign and its proper installation, to harmonize the area where it is installed.
The city council authorizes the home owner association with prior written notice to the Department of Public Works and Regulations to remove, dismantle and/or withdraw all sign without a municipal license or that is found in green areas.
It is recommended that all owners comply with their responsibility in regards to the adequate maintenance of the front of their property, keeping it painted, without broken glass, and in particular that public easements are clean and with well maintained flowerbeds.
Any one or more trees that is brought down within the colony should have all the permits from the authorities in addition to the approval from the association. For each tree that is brought down, there is an obligation to plant and care for ten trees as indicated by the Reforestation Committee of the Fraccionamiento.
The Committee of Projects and Ecology Conservation shall be integrated by the Board of Directors elected by the Assembly.
THE CONSTRUCTION
BASED ON THE ABOVE, THE SERIES OF STEPS AND PROCEDURES WHICH NEED TO TAKE PLACE BEFORE STARTING ANY ACTIVITY RELATING TO CONSTRUCTION IS AS FOLLOWS.
THE CONSTRUCCION PERMIT
An application for a construction permit must be submitted to the Administration office of Fraccionamiento San Juan Cosala Raquet Club, A.C. 30 days before any planned construction activity.
THE CONSTRUCCION REGULATIONS
A copy of the GENERAL REGULATIONS OF CONTRUCTION ECOLOGY, LANDSCAPE AND SEVERAL will be given to the owner and/or architect, as well as the commitment letter, which needs to be signed upon receipt.
CONSTRUCTION PLANS
The owner and/or architect have the obligation to present four copies of the original construction plans which will contain, a level drawing in the scale of 1.100.
ARCHITECTUAL DESIGN OF THE HOUSE
All plans shall have the floors, elevations, cuts of the construction, roofs indicating the percentage of inclination in case it is necessary, the natural ground level, street level in case filling is pretended, embankment cut, have the levels, the quantity, volume and location must be detailed and presented as well as the cut in relation to the adjoining properties before initiating any construction work.
COPY OF THE OWNERS PROPERTY DEED REGISTERED BEFORE THE PUBLIC REGISTRY OF PROPERTY; deliver a copy, as well as the official identification of the promoter.
WATER RECYCLING AND PROTECTION OF AQUIFERS: The drainage system of soapy water (showers and sinks) shall be independent of the waste water (toilets, kitchen or washers) which will lead to a recycling system (sand or gravel filter) and stored into a underground retention tank and so this water can be reused for toilets and garden irrigation. Once all the documentation has been handed in, the Committee and
Municipal Public Works will do the physical technical inspection of the site where the construction is proposed to take place. Both entities will resolve in a period of no more than fifteen working days on its decision to approve or indicate the adjustments to the project which are required in case it was has not been approved. You must obtain the construction permits from the corresponding authorities.
I. BILLS FOR OF THE CONSTRUCTION FEES AND DEPOSIT:
The owner is obligated to pay a quota for the authorization of the project, inspection of the construction during the construction period, and maintenance of the roads and curbs; and must leave an authorization deposit, which will be reinstated once all construction work ends and any excess material and debris is removed to the satisfaction of the administration. In case you do not comply with the above, the home owners association will remove the material and debris with the funds deposited for this purpose; and the funds will not be given to the owners. The adjacent empty lots will not be used as storage for material or debris deposit without the written approval of the property owner. Within your own property you are to build a storage shed and provide a latrine for your employees.
NOTE: Proprietors of the Fraccionamiento San Juan Cosala A.C. are hereby subject to comply with the Internal Regulations, Municipal, and the Law of Urban Fraccionamientos of the State of Jalisco repealing the zoning regulations of the State of Jalisco and other applicable correctives.
SIZE OF LOT
The minimum surface of each lot shall be 650 square meters and may not be subdivided for resale.
USE OF LOT
All construction which is seen as new construction shall only be a single family residence.
It is strictly prohibited for all property owners, moral or physical persons, to carry out the following uses: build villas, bungalows, finished apartments in vertical or horizontal position, provide areas for trailer parks or mobile homes, any type of business, change of zoning use or condominium regimen in any of its modifications.
OF THE CONSTRUCTION
The land, lots and buildings within the Fraccionamiento San Juan Cosala Raquet Club, A.C. is destined for single family low density residential use, and are subject to the comply to the following guidelines.
The minimum surface of the lot shall be 650.00 square meters.
The minimum frontal size of the lot shall be 15.00 linear meters
The size of the building construction shall be 650.00 square meters per household.
The occupancy coefficient of the land shall not be greater than 0.5 to the total surface of the lot.
The occupation coefficient of the utilization of the land shall not be greater than 0.7 therefore the total built surface shall not exceed 70% of the total surface area of the lot
The maximum permissible height of the construction shall be 4.50 meters from the NATURAL level of the lot (the heights point of the lot) including antennas, water tanks, cupolas, chimneys, etc. This level may not be greater than that allowed otherwise the owner will have to lower the building by demolishing to the permitted level and will receive an economical sanction or a fine set forth by the Board of Directors.
The construction shall respect a 5.00 meter frontal easement, on this surface there shall be a semi-enclosed (variants depending on the topography of the land) garden area: when the lot is located in the corner of two streets the owner must define in their project which street will be the entryway or main front, in such a way that the other boundary will become one of the lateral easements.
Side easements will be 2.00 meters being completely free of all construction and completely a garden area.
The minimum measurements of the construction shall be that of 110.00 square meters, not including car port, balconies or swimming pools. And the project must contain at least 1 bedroom, kitchen, living-dining room, a bathroom and service area.
Entire building must be constructed taking into account the natural context, minimizing the panoramic obstruction of the mountains and the lake in the neighboring properties. In the event that the property does not have neighboring constructions, in the set floor plan project (1,100) the surrounding land marking the easements with a dotted line must be submitted
Any type of prefabricated construction in any type of material is prohibited. All service rooms shall be covered and hidden from direct view of the public, as well as the water tanks and antennas of any television.
FENCES AND/OR WALLS
Perimeter walls shall be of a maximum height of 2.50 meters taking into account the natural level of the land.
VEHICULE PARKING
All property owners shall provide parking for their vehicle within their property, as well as space for boats, trailer etc within the lot. No trailer motor home will be permitted in a development of residential use. The only exception is that the owner uses their trailer motor home during the construction period of their house or that the trailer motor home is used for a period not to exceed 18 days within the lot of the owner.
WATER SUPPLY
All constructions that have a water intake main shall have a water meter installed in the frontal easement with easy access for the administration in order to facilitate the consumption reading.
The water shall be only used in the lot pertaining to the home owners association and for no reason shall the supply be used for neighboring lots.
It is strictly forbidden to wash cars in the street with a water hose and washing of the streets etc.
All members with dues in arrears will have their water services reduced, and shall have to bring up to date their maintenance dues in order to request a reconnection, the service reconnection will be paid by the owner.
CLEANING OF STREETS ANS EASEMENTS
The property owners shall maintain their street free of weeds, trash, waste, debris and similar material as well as maintain their easements clean and in good standing.
You will be given the applicable sanction if you dump garden DEBRIS in the surrounding lots or others within the fraccionamiento without prior approval.
You will be given the applicable sanction if you throw trash in the surrounding lots or those within the fraccionamiento.
CLEANING OF THE SEPTIC TANKS
The septic tank shall be cleaned at least once a year, with the payment of the corresponding fee the fraccionamiento may provide this service. Proof that such cleaning has taken place at least once a year shall be given to the homeowners association.
OTHER SERVICES
The administration of the owners association will provide and promote the following services:
Lighting of streets and avenues
Maintenance of the drainage of streets and avenues for storms
Water Supply
Security service
Garbage collection
Q.. VARIOUS
Persons driving motorized vehicles of any type, and speeding or causing excessive noise which disturb the peace and tranquility of the fraccionamiento will be fined.
Security guards shall be treated with the respect that they deserve.
Only cats, dogs, birds ect. will be allowed as pets. They shall be under the responsibility of the owners so that they do not inconvenience the neighbors, and must be on a leash in public area.
Animals that cause environmental pollution and bad odors, such as pigs, cattle and poultry are not permitted.
Any complaint that owners have to make must be in writing and annotated in a special book or logbook, in order to resolve such complaint.
All the neighbors of the fraccionamiento owners, have the obligation to a abide by that which is established in these regulations, as well as notify the administration office of the association of persons who have violated any of the rules, and be able to apply the corresponding sanctions.
R. FINES AND SANCTIONS
The fines and sanction are applicable to all members who have infringed the present regulations, to the consideration of the Board of Directos, the sanction to be applied in the following way:
TYPE A : From 1 to 20 daily minimum salary applicable to this region
TYPE B : From 21 to 35 daily minimum salaries
TYPE C : From 36 to 45 daily minimum salaries
TYPE D : From 46 to 50 daily minimum salaries
TYPE E : Determined by the Board of Directors
Any owner of one or more lots of Fraccionamiento San Juan Cosala Raquet Club by the mere fact of being one is obligated to:
To construct upon the lot or lots only a residential house, for it is definitely prohibited to build constructions destined to be a canteen, gambling house, or other similar immoral or illegal purposes.
To subject your construction in style, proportion and quality of material used to those corresponding to a residential type Fraccionamiento.
To respect all easements of gardens and those indicated by the General Planning Direction and Municipal Public Works, in accordance with the applicable building regulations in the municipality of Jocotepec, Jalisco.
That exterior perimeter walls built do not exceed 2.50 two meters with fifty centimeters in height.
That the estate to be built may not consist of more than one floor.
To not build more than one residential house for each 650.00 six hundred fifty meters square.
That the minimum surface of a constructed residential house, shall be of 80.00 eighty square meters
To not admit within the estate other animal other than cats, dogs and birds.
To pay their dues for the maintenance of the lighting, water supply, security service, and garbage collection, that are proportioned and distributed among the owner of lots.
To not build in a strip of 5.00 five meters in the front side of the lot.
To not subdivide the lot or lots into surfaces smaller that 650.00 six hundred fifty square meters per lot.
The sanctions corresponding to the Municipality of Jocotepec, shall be valued and implemented by the Director office of Municipal Public Works.
To the present regulations of construction, ecology, landscape and several for Fraccionamiento San Juan Raquet Club, A.C. Apply articles pre-established by the Law of Urban Fraccionamientos of the State of Jalisco repealed by the Law of Urban Development of the State of Jalisco, as well as the Law of Income of Jocotepec Municipality and other correlatives.

Persons driving motorized vehicles of any type, and speeding or causing excessive noise which disturb the peace and tranquility of the fraccionamiento will be fined.
Security guards shall be treated with the respect that they deserve.
Only cats, dogs, birds ect. will be allowed as pets. They shall be under the responsibility of the owners so that they do not inconvenience the neighbors, and must be on a leash in public area.
Animals that cause environmental pollution and bad odors, such as pigs, cattle and poultry are not permitted.
Any complaint that owners have to make must be in writing and annotated in a special book or logbook, in order to resolve such complaint.
All the neighbors of the fraccionamiento owners, have the obligation to a abide by that which is established in these regulations, as well as notify the administration office of the association of persons who have violated any of the rules, and be able to apply the corresponding sanctions.
R. FINES AND SANCTIONS
The fines and sanction are applicable to all members who have infringed the present regulations, to the consideration of the Board of Directos, the sanction to be applied in the following way:
TYPE A : From 1 to 20 daily minimum salary applicable to this region
TYPE B : From 21 to 35 daily minimum salaries
TYPE C : From 36 to 45 daily minimum salaries
TYPE D : From 46 to 50 daily minimum salaries
TYPE E : Determined by the Board of Directors
Any owner of one or more lots of Fraccionamiento San Juan Cosala Raquet Club by the mere fact of being one is obligated to:
To construct upon the lot or lots only a residential house, for it is definitely prohibited to build constructions destined to be a canteen, gambling house, or other similar immoral or illegal purposes.
To subject your construction in style, proportion and quality of material used to those corresponding to a residential type Fraccionamiento.
To respect all easements of gardens and those indicated by the General Planning Direction and Municipal Public Works, in accordance with the applicable building regulations in the municipality of Jocotepec, Jalisco.
That exterior perimeter walls built do not exceed 2.50 two meters with fifty centimeters in height.
That the estate to be built may not consist of more than one floor.
To not build more than one residential house for each 650.00 six hundred fifty meters square.
That the minimum surface of a constructed residential house, shall be of 80.00 eighty square meters
To not admit within the estate other animal other than cats, dogs and birds.
To pay their dues for the maintenance of the lighting, water supply, security service, and garbage collection, that are proportioned and distributed among the owner of lots.
To not build in a strip of 5.00 five meters in the front side of the lot.
To not subdivide the lot or lots into surfaces smaller that 650.00 six hundred fifty square meters per lot.
The sanctions corresponding to the Municipality of Jocotepec, shall be valued and implemented by the Director office of Municipal Public Works.
To the present regulations of construction, ecology, landscape and several for Fraccionamiento San Juan Raquet Club, A.C. Apply articles pre-established by the Law of Urban Fraccionamientos of the State of Jalisco repealed by the Law of Urban Development of the State of Jalisco, as well as the Law of Income of Jocotepec Municipality and other correlatives.
